Estate Litigation
The process of Estate litigation is difficult to operate on a fixed price schedule, as each case is unique and may involve significantly different amounts of time.
Your initial strategy meeting is charged at a flat rate of $220.00. At this meeting, we will discuss your situation and objectives, and provide you with advice in relation to the strength of your position, the process and the anticipated timeframe involved. After the meeting, we will provide you with thorough information about the costs for each stage of the process. It is important to us that our involvement in any estate dispute is commercially worthwhile. Throughout the process, we will constantly reassess your options, re-evaluate your strategy and position, and provide updated advice at each stage.
Estate Administration
Wherever possible, we try to provide a fixed cost estimate for the estate administration process.
The costs involved in administration of an estate will depend on how much of the administration you would like to delegate to us, and how much you would like to undertake yourself. Most Executors or Administrators of an Estate will engage a lawyer to prepare and lodge a Probate or Letters of Administration application on their behalf.
Our costs for the preparation of this application are $1,500.00. The lodging fees are charged by the Probate Office, and are calculated based on the size of the Estate. These fees can be found on the Supreme Court website: Probate Office fees | The Supreme Court of Victoria
If the application has any element of complexity (for example the Will is not signed or witnessed in accordance with the formal requirements, or there is a question about the capacity of the testator to sign the Will), we will provide you with a fixed fee estimate based on the circumstances.
Additional charges apply if you would like our assistance with the administration of the estate (that is, liaising on your behalf with financial institutions, share registries, beneficiaries, etc.). Estimated fees will be provided to you after our initial meeting, if you do choose to engage our services beyond the application for the Grant.
Estate Planning
The Essential Package
For people who just want the basics. This package assumes you do not have any interest in a private trust or company, or a SMSF.
This package is suitable for people who do not have any overseas or interstate assets or foreign resident beneficiaries, and do not require any advice relating to estate planning for blended families or vulnerable beneficiaries.
It does not include testamentary trusts.

+ Preparation of Enduring Power/s of Attorney
+ Final meeting with you to review and sign original documents or finalising documents and posting to you with signing instructions

The Complete Package
Our most popular package.
This package is perfect for the discerning testator with some minor complexities (blended family, or existing trust/business interest), and people who would like to make use of a testamentary trust to provide asset protection and tax effectiveness for their beneficiaries. This package is not suitable for you if you have multiple entities and / or complex circumstances.
Includes everything in the Essential Package, plus:
+ One style of testamentary trust (that is, either a life interest, right to occupy, discretionary testamentary trust, protective testamentary trust or bespoke testamentary trust)
+ Estate Planning review of 1-2 existing entities (trust, company or SMSF) OR blended family advice
+ Liaising with your accountant and/or financial planner
+ Documentation to assist you with the completion of a DIY Advanced Health Care Directive
+ Documentation to assist you with the completion of a DIY Legacy Wishes document
+ My Legacy Folder

The Deluxe Package
This package is perfect for people with a higher level of complexity in their objectives or personal circumstances, which may be discussed in more detail at your initial strategy meeting. It is also the most commonly selected package for people who would like to include detailed instructions for after their passing. Additional entities, bespoke provisions, foreign resident beneficiaries and overseas/interstate assets may involve additional fees which would be discussed during the strategy meeting.

+ Review of 3-4 existing entities
+ Blended family advice
+ Assisted completion of Advanced Health Care Directive
